Terms of Service

1. Agreement to Terms

By accessing or using kakisewa (“the Service”, “we”, “us”, or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not use the Service. These Terms apply to all users, including property agents, negotiators, and any other individuals who register for an account.

The Service is operated by the owner of kakisewa, currently registered in Malaysia. References to “you” or “your” refer to any individual or entity using the Service.

2. Description of Service

kakisewa is a software-as-a-service (SaaS) customer relationship management (CRM) platform designed for Malaysian property agents and negotiators. The Service enables you to manage tenancy contracts, track owner leads, send WhatsApp communication templates, monitor rental collections, and view performance analytics.

The Service is currently in beta. Features, pricing, and availability may change. We will notify registered users of material changes by email or in-app notice.

3. Account Registration

You must create an account to use the Service. You agree to provide accurate, current, and complete information during registration and to keep your account credentials confidential. You are responsible for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that we reasonably believe have provided false information, violated these Terms, or engaged in fraudulent activity.

4. Trial Period and Subscription

New users may access the Service under a 14-day free trial. A one-time commitment fee of RM 9.90 is charged at the start of your trial to verify your payment method. This amount is non-refundable and is credited toward your first subscription invoice if you continue.

After the trial period, continued access requires an active paid subscription. If you do not subscribe before your trial expires, your account will be placed in read-only mode — your data will be preserved, but you will not be able to add or edit records until you activate a plan.

Available plans (beta pricing, subject to change):

• Starter — Free. Up to 10 properties. Core features.
• Pro — RM 99 per month. Up to 50 properties. AI receipt verification, automated reminders.
• Elite — RM 299 per month. Unlimited properties. All features including LHDN filing assistance.

Subscriptions are billed monthly in advance. You may cancel at any time; cancellation takes effect at the end of the current billing cycle.

5. Payments and Refunds

Payments are processed securely by Stripe. We accept credit cards and debit cards (Visa, Mastercard). We do not store your full card details on our servers.

All fees are stated in Malaysian Ringgit (MYR) and are exclusive of any applicable taxes. You are responsible for any taxes or duties imposed by your local jurisdiction.

We do not offer refunds for partial months of service. If you believe a charge is in error, contact us within 14 days of the charge at support@kakisewa.com.

6. Your Data

You retain full ownership of all data you enter into the Service, including tenant names, phone numbers, property addresses, contract details, and uploaded files. We do not sell, share, or exploit your data for advertising purposes.

We may process your data as necessary to deliver the Service, including storing it on cloud infrastructure in Singapore or the United States. See our Privacy Policy for full details.

Upon account termination or cancellation, we will retain your data for 90 days and then permanently delete it, unless you request earlier deletion by contacting us.

7. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation in Malaysia or elsewhere.
• Send unsolicited bulk communications or spam via WhatsApp or any other channel.
• Impersonate any person or entity.
• Attempt to gain unauthorised access to any part of the Service or its infrastructure.
• Use the Service for any purpose other than legitimate property management activities.

8. WhatsApp Integration

The Service provides tools to generate WhatsApp message links (“wa.me” links) and, where configured, to send messages via WhatsApp Business API. By using these features, you agree to comply with WhatsApp’s Business Policy and to only message individuals who have consented to receive communications from you.

You are solely responsible for the content of any messages sent through the Service. We are not liable for any penalties, account bans, or disputes arising from your WhatsApp communications.

9. Intellectual Property

The Service, including its design, code, logos, and content, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use the Service solely for your internal business purposes during your active subscription.

You may not copy, reproduce, modify, sell, or distribute any part of the Service without our express written permission.

10. Disclaimers

The Service is provided “as is” and “as available” without warranty of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We make no warranty as to the accuracy or completeness of any information provided through the Service.

Nothing in the Service constitutes legal, financial, or regulatory advice. Commission estimates and renewal alerts are indicative only. You should verify all material information independently.

11. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service, including but not limited to loss of profits, data, or goodwill, even if advised of the possibility of such damages.

Our total cumulative liability to you for any cause of action arising under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or if we discontinue the Service. You may terminate your account at any time by contacting us.

Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination (including Sections 6, 9, 10, 11, and 13) shall survive.

13. Governing Law and Disputes

These Terms are governed by the laws of Malaysia. Any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Malaysia.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting a notice in the Service or by email at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes your acceptance of the updated Terms.
